Terms and Conditions for Agata AI Chatbot
Introduction
Welcome to Agata2u.com. By signing up for the Agata AI Chatbot service (“Service”), you agree to be bound by the following terms and conditions (“Terms of Service”). These Terms of Service affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Service, do not access or use the Service.
Account Registration
To access and use certain features of the Service, you must register for an account. By creating an account, you agree to (a) provide accurate, current, and complete account information, (b) maintain and promptly update your account information, (c) maintain the security of your password, and (d) accept all risks of unauthorized access to your account.
Free Trial
The “Agata AI Chatbot – Free Trial – Agata 1.0 AI Chatbot Free Trial” offers you access to the Service free of charge for the initial month(s) as specified in the corresponding subscription plan. After the trial period, you will automatically be charged the subscription fee for the next billing cycle unless you cancel your subscription before the trial period ends.
Subscription and Payment
Following the free trial, continued use of the Service requires payment of a subscription fee. Details of the subscription options and fees will be provided separately and are considered an integral part of these Terms. You agree to pay all applicable fees related to your use of the Service. All fees are non-refundable and non-transferable.
Subscriptions may be terminated by email to enquiry@agata2u.com, one month before the expiry of the subscription (i.e. for subscriptions with yearly renewal terms running from April to March, the termination notice must be received before the end of February). Alternatively, users can cancel their subscription from the “Member Login” dashboard. The agreement cannot be terminated for a period of subscription already initiated and the Customer will not be entitled to a refund for that subscription period.
Use of Service
The Service is provided for your personal and commercial use. You agree not to use the service for any illegal or unauthorized purpose. You are responsible for all content that you transmit or otherwise make available through the Service.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Agata2u.com and its licensors.
Operating Stability
Agata2u aims to provide the highest possible degree of operating stability but is not responsible for any breakdown caused by factors beyond its control. Such breakdown includes but is not limited to power failures, server crashes, telecommunications connections or the like. In all events, Agata2u aims to re-establish normal operations as quickly as possible.
System Changes & Feature Updates & Maintenance
Agata2u informs its users on the Agata2u user platform about system changes, feature updates, and other technical news by email. Therefore, all registered users on the Agata2u user platform accept that their name and email used for the registration are added to the technical newsletter mailing list.
Agata2u is entitled to make operational changes to the System for improvements or otherwise (for example by developing or updating software) with giving the Customer prior notice of 7 days.
Limitation of Liability
In no event shall Agata2u.com, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Marketing
Agata2u shall be entitled to refer to the Customer name and logo and the Services provided in its marketing collateral, including a brief description of such services. Material on the website, flyers, presentations, outreach and any material displayed publicly are considered marketing collateral for the purpose of this clause.
Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
